Welcome to AAA VPN. These Terms of Use ("Terms") form a legally binding agreement between you ("you" or "User") and Wartraf sp. z o.o. ("we", "us", "our", or "AAA VPN"). These Terms govern your access to and use of the AAA VPN mobile application ("App") and our website ("Website"), collectively referred to as the "Service."

AAA VPN is a comprehensive VPN application integrated into your device, designed to provide secure, encrypted internet access, protect user privacy, and support anonymous browsing. The application also features an integrated connection speed test, allowing users to identify and connect to the fastest available server for optimal performance.

Please read these Terms carefully before downloading or using our Services and any feature provided therein. By clicking the “Download” (or similar button), installing or using the Services you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not accept these Terms, you may not access or use the Service.

Eligibility and Age Requirement

By agreeing to these Terms, you confirm that you are legally competent to enter into this agreement and are not restricted by any law, regulation, or judicial order from doing so. If you are acting on behalf of a company or other organization, you represent that you have the necessary authority to bind that entity to these Terms.

You also acknowledge that you are at least sixteen (16) years old. If you are under the age of 18, you should review these Terms with a parent or legal guardian. We reserve the right to verify your age at any time to ensure that children (as defined under applicable law) are not using the Services.

Service Plans

A Our Service offers both free and paid options:

Free Mode:

This mode includes VPN functionality and ad-blocking, allowing users to access a limited selection of servers with basic data transfer bandwidth.

Free Trial Period:

During the trial period, users have access to full VPN functionality and ad-blocking, with the ability to connect to all available servers at the highest data transfer speeds. After the trial ends, the service will automatically transition to a paid subscription. The details of the trial period, including its duration, will be provided during the sign up.

Paid Mode:

Users can choose a paid subscription immediately, gaining unrestricted access to the full range of services without any limitations. By purchasing, you authorize our payment providers to charge the applicable fees to the payment card you provide. At the end of the Service period, your Subscription will automatically renew for the next term unless you cancel prior to the renewal date. If you do not cancel your Subscription before the renewal date, your payment method will be charged the applicable renewal price for the upcoming period.

All payments, renewals, and cancellations for Android users are subject to and managed under Google Play’s payment policies and terms. Please refer to Google Play’s Terms of Service for more information about billing and subscription handling.

AAA VPN reserves the right to update pricing, features, and subscription terms at its discretion. Any such changes will be communicated through service notifications or by email.

Prohibited and restricted use

By using our Service, you agree not to:

Engage in activities such as financial fraud, identity theft, hacking, phishing, digital piracy, or any other illegal or criminal conduct, including actions that result in an excessive number of automated requests.
Promote or engage in harassment, threats, stalking, or any form of discriminatory or bigoted behavior.
Distribute unsolicited communications, including spam, mass emails, or hate messages.
Use unauthorized payment methods, such as stolen credit cards.
Upload, download, or distribute any form of child pornography.
Transmit any viruses, malware, or malicious code intended to disrupt or damage systems.
Disrupt or interfere with the performance or integrity of the Service in any manner.
Attempt to gain unauthorized access to accounts, systems, or networks.
Use third-party software to manipulate or disrupt the Service.
Violate or attempt to circumvent any of these Terms.

License and Ownership

Subject to your compliance with these Terms, we grant you a personal, limited, non-transferable, revocable, non-sublicensable, and non-exclusive license to access, use, download, and install the most current version of our Service. This license is granted solely for your lawful, personal, and non-commercial use. You are prohibited from allowing others to use, copy, share, distribute, resell, transfer, sublicense, or offer the Service, in whole or in part, for any commercial purposes.

You acknowledge and agree that all rights, titles, and interests in our trademarks, service marks, code, software, protocols, documentation, and any related components or derivatives, including any improvements or modifications, are our exclusive property. These are protected under international copyright, trademark, patent laws, and other intellectual property rights worldwide, including trade secrets and moral rights.

You may not alter, delete, or remove any copyright, trademark, or proprietary rights notices included in the Service. Except as explicitly granted herein, we retain all rights to the Service and any associated content. We reserve the right to disable access to the Service for anyone found infringing upon intellectual property rights.

By using the Service, you consent to the collection and processing of your personal information in accordance with our Privacy Policy. Updates and Modifications of the Service

We reserve the right, at our sole discretion, to modify, update, add, or remove any features or functionality of our Services at any time, without prior notice. Unless otherwise specified, all updates will be considered part of the Service and subject to these Terms. Additionally, we may choose to discontinue certain features or all of the Services at our discretion, including any updates, upgrades, or bug fixes. You acknowledge that we will not be held liable for any changes, suspensions, or discontinuations of the Services or any portion thereof.

Account Creation and Responsibility

To use our Services, you need to create an Account by providing essential information such as your email, password, billing info, and country. You are responsible for maintaining the privacy of your account details and ensuring no unauthorized use occurs. Any actions performed under your account are your responsibility. If you notice or suspect any unauthorized access, please alert us immediately.

We explicitly disclaim all warranties, whether express or implied, regarding the Services, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. The Services are provided "as-is" and "as-available." You use the Services, including all information and features offered, at your own risk.

We do not guarantee that the Services will be available without interruption, secure, free from viruses, worms, harmful components, or any program limitations. We do not warrant that any content or information accessed through the Services is accurate, reliable, or truthful. Additionally, we make no guarantee that we will correct any errors, defects, or omissions.

We are not responsible for any loss, injury, or damage incurred from your use of the Services, including, but not limited to, any loss of data or damage to your device, whether express or implied.

Limitation of liabilities

You expressly acknowledge and agree that, under no circumstances, shall we (including, without limitation, our affiliates, officers, directors, employees, agents, vendors, distributors, third-party licensors, or equipment and service providers) be held liable for any direct, indirect, incidental, special, punitive, consequential, or exemplary damages. This includes, but is not limited to, damages for lost profits, business opportunities, goodwill, or any other intangible losses, even if we have been informed of the potential for such damages, arising out of or related to these Terms, or your use or inability to use the Services.

Our total liability shall be limited to the amount you paid for the Services or a maximum of $30, whichever is lower. In jurisdictions where the exclusion or limitation of liability for damages is not permitted, our liability will be limited to the maximum extent allowed by law.

Indemnification

You agree to indemnify, defend, and hold harmless us (including our affiliates, subsidiaries, successors, contractors, employees, directors, agents, suppliers, licensors, service providers, and partners) from any and all claims, damages, losses, liabilities, costs, debts, and expenses (including attorney fees) arising out of: (i) your use of any of our Services; (ii) your violation or breach of any provision of these Terms; and (iii) any damage, whether direct, indirect, special, or consequential, that you cause to any third party in relation to your use of the Services, including any violation of third-party rights.

Termination and Governing Law

These Terms are effective from the moment you first access the Service and will remain in effect until terminated by either you or us. You may terminate these Terms at any time by ceasing to use the Service and canceling any future use as outlined above. If you breach any of these Terms, we have the right to terminate your access to the Service, including deactivating your account. Additionally, we may, at our sole discretion, suspend or terminate your access to all or any part of the Service, or your account, for any reason, at any time, without any liability or penalty to you or third parties.

Any disputes or claims arising out of these Terms, or relating to their breach, termination, or invalidity, will be governed by the laws of Poland. Such disputes will be resolved exclusively by the courts in Poland.

Severability

If any provision of these Terms is determined to be unenforceable or invalid by a competent authority, that provision will be modified or removed to the minimum extent necessary, so that the remaining provisions of these Terms will continue to be valid and enforceable.
