By downloading, installing, or using the AAA VPN software and its related features, you are confirming that you have read, understood, and agree to be legally bound by the terms of this End-User License Agreement (“EULA”). If you do not accept these terms, you must not use the Software. In such case, uninstall and delete any part of the Software from your device immediately.

This EULA outlines the rules governing your access to and use of the AAA VPN application (“Software”), along with all associated features, services, and content (collectively, the “Services”). Use of the Services indicates your agreement with these terms.

Please note that AAA VPN reserves the right to modify or update this Agreement at any time, at its sole discretion. The most recent version of the Agreement will automatically apply to the version of the Software you are using, including any updates or new releases. We encourage you to review the EULA regularly to stay informed of any changes.

General Terms

The AAA VPN application is a virtual private network service offered by Wartraf sp. z o.o., intended solely for individual, non-commercial use. By choosing to install or use this software, you acknowledge and accept full personal responsibility for any consequences arising from its usage. Wartraf sp. z o.o. disclaims any liability for any direct, indirect, incidental, or consequential damages, including legal fees or related costs, regardless of any conflicting legal provisions that may exist.

By accepting this Agreement, you are granted a limited, revocable, and non-exclusive license to install and use AAA VPN in accordance with its described functionality. This license is strictly conditioned upon your adherence to the provisions of this End-User License Agreement (EULA), including all restrictions, limitations, and lawful obligations.

The AAA VPN software and services are the intellectual property of Wartraf sp. z o.o., protected by international copyright and trademark laws. All rights, ownership, and interest—including but not limited to trademarks, service marks, trade secrets, and any other intellectual property—remain fully vested in Wartraf sp. z o.o. Unless explicitly permitted under this Agreement or authorized in writing, you may not modify, reproduce, distribute, reverse engineer, sublicense, or otherwise tamper with any part of the software.

The granted license does not authorize any commercial usage. Any attempt to use AAA VPN on behalf of a business, organization, or other entity without prior authorization shall be considered a violation of this Agreement. Your continued use of the AAA VPN software constitutes your agreement to all terms outlined herein and represents your commitment to comply with applicable regulations.

Usage Restrictions

Your access to the AAA VPN Services and Software is subject to limitations. Unless explicitly authorized by this Agreement or explicitly permitted within specific functionalities of the Services, the following actions are prohibited:

Unauthorized Use and Distribution: You are not permitted to copy, reproduce, distribute, rent, sell, lease, lend, assign, export, sublicense, or otherwise transfer the Software or any part of the Services to any third party.

Tampering and Reverse Engineering: Any attempt to decompile, reverse engineer, translate, disassemble, decode, or derive the source code, algorithms, architecture, or protocols of the Software or Services is strictly forbidden. Likewise, you may not create derivative works or adaptations of the Services.

Commercial Misuse and Resale: You may not use the Services or Software for commercial gain or operate them in conjunction with other products for unauthorized or competitive purposes.

Intellectual Property Violations: It is prohibited to remove, obscure, or modify any proprietary notices, including copyright or trademark designations embedded within the Services.

Security Interference: You may not interfere with or disrupt the integrity, performance, or security of the Services, networks, servers, or systems. Activities such as overloading servers, injecting malware, launching denial-of-service attacks, or exploiting vulnerabilities are explicitly prohibited.

Privacy and Rights Infringement: You must not use the Services to infringe on the rights of others, including (but not limited to) intellectual property rights, personal data protection laws, or communications regulations. Tracking, storing, recording, or transmitting the personal information of others without consent is strictly disallowed.

Unauthorized Access: Attempting to access restricted areas of the Services through hacking, password mining, or any other means of bypassing authentication mechanisms is a direct violation of this Agreement.

Legal Compliance: All usage must remain fully compliant with applicable local, national, and international laws, including but not limited to copyright, trademark, and data protection legislation.

Disclaimer of Warranties

The AAA VPN Software and Services are made available strictly on an “as is” and “as available” basis, without any warranties of any kind—express, implied, or statutory. By using the Software, you acknowledge and agree that you do so entirely at your own risk.

To the fullest extent permitted under applicable law, Wartraf sp. z o.o. explicitly disclaim all warranties and guarantees, including but not limited to: а) implied warranties of merchantability; b) fitness for a particular purpose; c) accuracy, reliability, or performance; d) non-infringement of third-party rights; e) or any warranties arising from course of dealing, usage, or trade practice. We make no guarantees that the Software will be uninterrupted, error-free, secure, or free of harmful components. You are solely responsible for the use of the Software, including any damage to your device, data loss, or inaccuracies in transmitted information.

Limitation of Liability

Under no circumstances shall Wartraf sp. z o.o., its affiliates, officers, employees, licensors, or partners be held liable for: a) any incidental, special, punitive, or consequential damages; b) any loss of profits, business opportunities, or data; c) any interruption, delay, or inability to use the Services; d) or any reliance placed on the Services’ functionality or availability. This applies regardless of whether we have been advised of the possibility of such damages and even in the event of failure of any limited remedy. Furthermore, our total aggregate liability—for any cause whatsoever and regardless of the form of action (contract, tort, negligence, or otherwise)—shall in no case exceed thirty U.S. dollars ($30.00). Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability, so these terms may not apply to you in full. In such cases, our liability will be limited to the maximum extent permitted by law.

Customer Support

During the validity of your license, AAA VPN may, at its sole discretion, provide technical support through available channels such as email or other forms of communication. Such support is offered on an “as-is” basis, without any guarantees regarding response time, resolution, or availability.

Please note:

• Any technical assistance provided does not imply a warranty of any kind.
• You are fully responsible for safeguarding your data, applications, and system configurations before seeking support.
• If a reported issue exceeds the standard support scope, AAA VPN reserves the right to decline, postpone, or terminate support services without prior notice or liability.

System Requirements & Responsibility

You are solely responsible for ensuring that your device, operating system, and internet connection meet the minimum system requirements necessary to access and use AAA VPN Services effectively. AAA VPN will not be held accountable for any delays or interruptions in Service that result from problems outside of its control, such as issues with your hardware, software, or internet connection.

Updates and Modifications to the Software

AAA VPN reserves the right to provide automatic updates, upgrades, or enhancements to the Software ("Updates") from time to time. These Updates may include improvements, bug fixes, security patches, and new features, and may be applied to the Software without prior notice.

AAA VPN may modify, alter, or discontinue certain features or the entire Software at its sole discretion. This includes, but is not limited to, changing existing features, adding new features, or removing certain functionalities altogether. We reserve the right to make such changes to enhance the service, improve performance, or comply with legal and regulatory requirements.

Inclusion of Third-Party Components

If AAA VPN software includes or is bundled with third-party programs, please note the following:

• Such third-party components are subject to their own license agreements, which may include open-source or free software licenses.
• This Agreement does not override, restrict, or expand the rights granted to you by those separate third-party licenses.
• our use of any third-party software is governed solely by the terms set forth by its respective licensor, and we encourage you to review them carefully.

Nothing in this EULA modifies or supersedes your legal rights under any applicable third-party license.

Miscellaneous

Jurisdiction and Governing Law. This Agreement shall be interpreted and enforced in accordance with Polish law, including international copyright regulations and treaties, without regard to any conflict of law principles. Any legal disputes related to this Agreement shall fall under the exclusive jurisdiction of the courts located in Poland.

Entire agreement. This document represents the complete and exclusive agreement between you and us concerning the subject matter, superseding any prior or concurrent agreements, whether written or oral.

Severability. In the event that any part of this Agreement is found to be unlawful or unenforceable by a competent court, that specific provision will be modified or limited to the minimum extent necessary, ensuring the validity and enforceability of the remaining provisions.

Termination of Agreement

This EULA comes into effect on the date you first use the Software and remains valid until it is terminated. You have the right to terminate it at any time by providing written notice to AAA VPN or by simply ceasing to use the AAA VPN App. Additionally, this agreement will automatically terminate if you violate any of this Agreement.
